Terms of Service

By purchasing my services (art), you agree to the following conditions.General Disclaimers
* I reserve the right to refuse or discontinue a commission at any time.
* Disrespectful behavior will not be tolerated and your commission will be cancelled with no refund.
* The terms outlined here may vary slightly depending on the type of commission.
* Commissions are for personal use ONLY unless Commercial Rights have been agreed and paid upon.
* My work will not be used to train AI or be used as an NFT in any present or future projects in any capacity.
* Deadlines must be agreed upon prior to the start of the commission.
* I will always do my best to complete your commission within a timely manner, but please understand that sometimes life may get in the way and cause a delay in completing your commission. I will notify you as soon as possible of any issues that come up to keep you informed.
* In the rare event I feel that I cannot complete the commission at all, I can give a partial refund depending on how much I have completed. (I will keep 25% of the total cost minimum).
Payment & Fees
* An invoice will be sent by me through my Ko-Fi as commission listing.
* A deposit of at least 50% (NON-REFUNDABLE) must be paid before I start working. Once the sketch is approved, the remaining balance must be paid in full before I continue working and finish the product.
Process
* Upon starting, I will send progress images of the sketch (and flat color if necessary) for your review to approve or make revisions before I proceed to finish the artwork. Once I receive confirmation of the sketch for me to continue working, refunds may not be requested at this point unless issued by me.
* Once I am finished, I will send one final check for your review. Three (3) minor revisions may be requested. More than three (3) will incur an additional fee that must be paid in full before I proceed to make adjustments.
* Once the finalized artwork is accepted, I will email you full res .png files of the work and watermarked .jpegs for social media posting. No physical product will be delivered.
Copyright
*I reserve the right to sign/watermark my own work.
* All commissions are for PERSONAL USE ONLY unless Commercial Rights have been agreed upon and paid.
* I retain all copyright over my work, which includes the right to use the image as a sample for sales or self-promotion unless otherwise agreed upon.
* You are NOT authorized to change, modify, edit or use my works without my permission. Most definitely you may NOT claim my art as your own.
* Do not trace, copy, or resell the commissioned artwork.
By commissioning me, this means you have properly read, understand, and AGREE to the terms listed above.

Tutoring

Grades Available: Kindergarten through 9th
Subjects Available: Math, English, Reading, Science

Sessions
* Regular sessions run 50 minutes and take place on Zoom.
* Longer sessions are available upon discussion. Shorter sessions are not available.
Fees Payable to the Tutor
* Fees shall be calculated at a rate of $30 per 50 minute session. No further fees shall be charged for traveling or preparation time of the tutor. Fees may be adjusted from time to time and shall become effective after having given the student seven days written notice.
Payment
* Payment shall be made upon agreement between Tutor & Student/Parent. Payment may be accepted in the form of an invoice provided via link by the tutor. Payments accepted through the following: PayPal, Ko-Fi, CashApp, Venmo, or Zelle.
Schedule of Lessons
* Tutoring charged at the rate of $30 per 50 minute session shall commence at date agreed upon by tutor and parents/guardians and thereafter on an adhoc basis as mutually agreed upon by tutor and parents/guardians. No further tutoring sessions will be completed until outstanding balance, if applicable, is paid in full.
Contact Availability of the Tutor
* The tutor will be available via for questions/concerns between the hours of 9:00AM and 8:00PM Monday through Sunday. Please allow 24 hours for email responses and 2 hours for text responses. The tutor will be most easily accessible by text. If first time communication or new number, please identify both PARENT and STUDENT name in text to avoid any confusion.
* Any and all reminders for sessions will be sent by TEXT & EMAIL from the tutor by 10:00AM on the day of session with Zoom Link and Passcode.
* Late Reminder will be sent by TEXT 5 minutes after session start time if student has not yet arrived.
Late Arrival & Change of Schedule
* Fees are calculated according to the scheduled time agreed upon by the tutor and parents/guardians. No adjustment to fees shall be made for time due to late arrival by the student or by early termination of session by the student. Any lost time due to the late arrival of the tutor shall be compensated by extending a lesson by mutual agreement and by such amount of time that was lost. The tutor agrees to wait twenty minutes from the time of the scheduled session for the student's arrival before considering that session cancelled without sufficient prior notice and therefore subject to a one time fee of five dollars (no-call/no-show fee), as well as a bill for the hour; to a combined total of thirty-five dollars.
Obligations of the Tutor
* The tutor undertakes to do all preparation prior to lessons and to structure lessons in such a way as to optimize time to the benefit of the student. The tutor shall keep confidential all information of the student and shall contact other parties involved in the education of the student only if given written permission by the student, or student's guardian, to do so.
Obligations of the Student/Parent/Guardian
* The student/parents/guardians undertake to assist the tutor in identifying problem areas in which the student needs specific tutoring. The student agrees to provide their own materials needed for each tutoring session. The student agrees that assignments, exercises, or homework form an integral part of tutoring and undertakes to complete such work timeously.
No Warranties
* The tutor makes no promises or warranties with regards to a student's performance as a result of any tutoring provided.
Status of the Tutor
* It is expressly understood that the student retains the services of the tutor as an independent contractor and not as an employee. The tutor shall be responsible for her own insurance and for all statutory declarations and contributions with regard to income tax.
Termination
* This tutoring contract may be terminated by either party at any time by giving the other party seven days prior written notice.
Relaxation of Terms
* No relaxation, indulgence, waiver or release by any party of any of the rights in terms of this agreement on one occasion shall prevent the subsequent enforcement of such rights and shall not be deemed to be a waiver of any subsequent breach of any of the terms.
Whole Agreement
* This agreement constitutes the entire understanding between the parties with regard to the subject matter thereof and the parties waive the right to rely on any alleged expressed or implied provision not contained herein. Any alteration to this agreement must be in writing and signed by both parties. Where the student is a legal minor, the parent/guardian shall enter into this tutoring contract on behalf of the student and shall accept and agree to all the terms and conditions contained herein on behalf of the student.
